A couple of strongly-worded judgments from the High Court this week show judges are unimpressed by attempts to pull the wool over their eyes.
NBR court reporter Hamish McNicol says a High Court judge found businessman Alex van Heeren did not “fully inform” the court of the whereabouts and value of wealth in a partnership with his former business partner, Michael Kidd.
But Justice John Fogarty has stopped short of saying Mr van Heeren is “deliberately refusing” to comply with an order to pay Mr Kidd an interim $US25 million.
Mr McNicol talks about Justice Fogarty’s reaction to Mr van Heeren seemingly attempting to drag out the already near 20-year dispute between the former partners.
Otherwise, Justice Peter Woodhouse had even stronger words for a twice-bankrupted property developer on Thursday.
Paul Alexander claimed a liquidator failed to pursue BNZ for causing loss to him by wrongfully transferring $1.6 million from an account has been found to be a forgery.
But Mr McNicol says Justice Woodhouse quickly discredited Mr Alexander’s evidence, and went as far as to say a letter he presented in court was a forgery.
