Legal experts agree the Financial Markets Authority (FMA) had to launch proceedings against former Eroad manager Hamish Sansom but the case itself raises the issue of using criminal versus civil actions.  

Mr Sansom was found not guilty of insider trading by a jury in the  High Court at Auckland
